These Terms and Conditions (“Terms”) govern your access to and use of edbrown.com and any other website operated by Ed Brown Products, Inc. that links to these Terms (collectively, the “Site”), as well as purchases placed through the Site. “EBP,” “we,” “us,” and “our” mean Ed Brown Products, Inc. “You” and “your” mean the person accessing the Site or placing an order.
Please read these Terms before using the Site or placing an order. By using the Site, submitting an order, or otherwise indicating your acceptance, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site or place an order through it.
1. Legal Eligibility and Lawful Use
You may use the Site and purchase products only if you have the legal capacity to enter into a binding agreement and your use and purchase are lawful where you reside and where the product will be received, possessed, installed, or used.
Firearms, firearm components, magazines, and related products are regulated. You are responsible for knowing and complying with all applicable federal, state, and local laws. You may not use the Site to purchase a product for a person who is prohibited from purchasing or possessing it, to evade a required background check or transfer procedure, or for any other unlawful purpose.
We may refuse or cancel an order when we reasonably believe completing it would violate applicable law, create a safety or fraud risk, or conflict with these Terms or our published policies.
2. Firearm Sales and FFL Transfers
Firearms purchased directly from EBP are shipped only to a Federal Firearms Licensee (“FFL”) that is legally permitted to receive the firearm. We must receive and verify a current, signed copy of the receiving dealer’s FFL before shipment.
The receiving FFL will conduct the transfer and required paperwork in accordance with applicable law. The FFL may charge you a separate transfer fee. You are responsible for selecting a willing FFL, complying with the FFL’s procedures, paying its fees, and establishing that you are legally eligible to receive the firearm.
Submitting and paying for an order does not guarantee that a firearm can legally be transferred to you. If a transfer cannot legally be completed, contact EBP for instructions. Do not arrange for a firearm to be returned without first obtaining authorization from EBP.
We do not ship firearms to a residential or other unlicensed address except where expressly permitted by applicable law and approved by EBP. All firearm transactions remain subject to applicable federal, state, and local requirements.
3. Product Information and Availability
We try to describe and display products accurately. Product photographs, colors, finishes, dimensions, specifications, and other details may nevertheless vary slightly because of manufacturing changes, screen settings, photography, or the nature of hand-fitted and finished products.
Product availability, specifications, options, estimated completion dates, and prices may change. An item appearing on the Site is not a guarantee that it is available or can lawfully be sold or shipped to a particular location.
We may correct typographical, pricing, specification, or availability errors and may update Site information without prior notice. If a material correction affects an order you have already submitted, we will contact you when reasonably practicable and provide the options available under the circumstances.
4. Orders and Acceptance
Your submission of an order is an offer to purchase. An automated order confirmation acknowledges receipt but does not necessarily constitute final acceptance of the order. We may verify order information, payment, product availability, legal eligibility, and FFL information before accepting or shipping an order.
We reserve the right to limit quantities and to decline or cancel an order for lawful reasons, including suspected fraud, payment problems, product unavailability, pricing or listing errors, legal restrictions, or inability to verify required information. If we cancel an order after collecting payment, we will refund the amount collected for the cancelled portion, subject to any separate written agreement governing a custom or made-to-order product.
Custom-built firearms, special configurations, personalized products, deposits, and made-to-order work may be governed by additional terms stated in a quote, order acknowledgment, invoice, build approval, or other written agreement. If those additional terms conflict with these Terms, the transaction-specific written terms control for that transaction.
5. Prices, Taxes, and Payment
Prices are stated in U.S. dollars unless indicated otherwise. Prices, promotions, shipping charges, and product availability are subject to change. The price shown when an order is submitted remains subject to correction of an obvious error and to any transaction-specific quote or written agreement.
You are responsible for applicable sales, use, excise, transfer, and other taxes or fees, including fees charged separately by a receiving FFL. We will collect taxes when required by law.
Current accepted payment methods are displayed during checkout or in our published Sales Policy. You represent that you are authorized to use the payment method submitted and authorize us and our payment processors to charge all amounts associated with the order.
6. Shipping and Delivery
Current shipping methods, charges, promotions, and ordinary processing estimates are shown during checkout or in our Sales Policy. Delivery and completion dates are estimates, not guarantees. Delays may result from production requirements, product availability, FFL verification, carrier restrictions, weather, legal compliance, or circumstances outside our reasonable control.
You must provide accurate shipping and contact information. Parts and non-firearm products will be shipped only to destinations we are legally and operationally able to serve. Firearms are shipped as described in Section 2.
Inspect delivered non-firearm products promptly. Contact us if a package is damaged, an item is missing, or you received the wrong product. Do not discard the product, packaging, or shipping materials until the matter is resolved.
7. Returns of Parts and Other Non-Firearm Products
A Return Merchandise Authorization number (“RMA”) is required before returning any product. Contact EBP to obtain an RMA and return instructions. The RMA must be displayed as instructed on the outside of the package. Unauthorized returns may be refused.
For parts and other non-firearm products purchased directly from EBP:
- Contact us within 30 days of the invoice date to request a return.
- Returned products must be shipped prepaid, in their original packaging when reasonably possible, and with the requested information.
- Except for an EBP shipping error or a defective item, only new, unused products are eligible for exchange or refund.
- Returns that are not the result of an EBP error or product defect are subject to a 20% restocking fee.
- Original shipping charges are nonrefundable except where required by law or expressly approved by EBP.
Products purchased from an authorized dealer or distributor must be returned to that seller for exchange or refund under that seller’s policies.
Parts that have been installed, fitted, altered, damaged, or used ordinarily are not returnable for refund or exchange. EBP may, in its discretion, offer a discounted replacement when a modified part is returned. Contact us before sending anything.
8. Firearm Returns, Service, and Warranty Claims
Firearm sales are not eligible for exchange or refund. This restriction does not eliminate any service or repair right available under EBP’s published service policies or written limited lifetime firearm warranty.
EBP firearms may be returned to the factory for authorized evaluation, service, repair, or warranty consideration. An RMA is required. Contact us before shipping any firearm and follow the instructions provided. Do not send ammunition with a firearm. You are responsible for complying with all laws and carrier requirements governing firearm shipment.
For a warranty claim, you must provide your name, physical address, telephone number, email address, the firearm’s serial number, its approximate purchase date, the seller’s identity, and a description of the claimed defect. Do not ship or otherwise return a firearm until EBP has issued a Return Authorization number and specific shipping instructions. Unauthorized or C.O.D. shipments will not be accepted. Freight must be prepaid unless EBP provides different written arrangements for a particular shipment. A firearm and ammunition must never be shipped together.
Evaluation, service, repair, and warranty coverage are determined under the applicable service policy and controlling written warranty. EBP may contact you with findings and obtain approval before performing chargeable work.
9. Warranty and Product-Safety Information
EBP’s written Limited Lifetime Warranty covers the original retail purchaser of a new Ed Brown firearm purchased from EBP or an authorized Ed Brown dealer, as well as each subsequent lawful owner of that firearm. For the lifetime of the firearm, EBP warrants that it will be free from defects in original materials and workmanship, subject to all terms and exclusions in the written warranty.
When EBP determines that a covered defect exists, the warranty’s exclusive remedy is repair or replacement, without charge, using the same or comparable parts or firearm, at EBP’s sole option and discretion. If replacement requires a different serial number, the owner must cooperate with EBP in completing the legally required buy-back, resale, paperwork, permits, shipment, purchase, and transfer procedures.
The Limited Lifetime Warranty does not cover defects or damage caused by abuse, misuse, accident, careless handling, hand-loaded, low-quality, or other non-standard ammunition, a barrel obstruction, improper care or maintenance, failure to follow the owner’s manual, normal wear and tear, rust or corrosion, unauthorized repair, adjustment, or alteration, or the firearm’s coating, springs, grips, electronic optics, tritium bulbs, or white outlines around tritium bulbs.
The complete written warranty, including its disclaimers, liability limitations, claim procedures, governing-law provision, and venue provision, appears in the Ed Brown 1911 Handguns Owner’s Manual. The summary in these Terms is provided for convenience only.
EBP parts are sold as-is and without a separate written warranty except where EBP expressly states otherwise for a particular product or where applicable law requires otherwise. Parts are intended to be installed by a qualified gunsmith. Improper installation, fitting, alteration, ammunition, maintenance, or use can damage a firearm and cause serious injury or death.
EBP parts and firearms are intended for factory-specification, standard-velocity ammunition unless EBP provides different written instructions for a particular product. Follow the owner’s manual, all product instructions, and accepted firearm-safety practices. Verbal installation guidance should be confirmed with a qualified gunsmith for your particular firearm.
Nothing in these Terms replaces, modifies, or expands the written Limited Lifetime Warranty applicable to an EBP firearm. If these Terms or another Site statement conflicts with that written warranty concerning a warranty claim, the written warranty controls.
10. No Professional or Gunsmithing Relationship
General information on the Site is provided for informational purposes. It is not a substitute for inspection, installation, fitting, repair, or advice by a qualified gunsmith who can evaluate the specific firearm and component. Viewing Site content or communicating with EBP does not create a gunsmith-client, fiduciary, or other professional relationship beyond any services EBP separately agrees in writing to perform.
11. Intellectual Property
The Site and its text, photographs, videos, graphics, logos, product names, designs, downloads, and other content are owned by or licensed to EBP and are protected by intellectual-property laws. You may view and use the Site for personal, lawful, noncommercial purposes related to evaluating, purchasing, maintaining, or obtaining service for EBP products.
You may not copy, reproduce, republish, modify, distribute, sell, exploit, scrape, or create derivative works from Site content without EBP’s prior written permission, except as applicable law expressly permits. Product manuals and installation instructions may be downloaded and used for their intended purpose.
12. Acceptable Use
You may not:
- Use the Site or any product for an unlawful purpose;
- Attempt to gain unauthorized access to the Site, customer accounts, systems, or data;
- Interfere with Site operation or security;
- Introduce malicious code or conduct automated scraping that burdens the Site;
- Submit false, misleading, fraudulent, or infringing information;
- Impersonate another person or misrepresent your authority; or
- Use Site content in a manner that violates EBP’s or another person’s rights.
We may restrict or terminate Site access when reasonably necessary to protect EBP, customers, the public, or the Site.
13. Customer Accounts
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for activity conducted through the account. Provide accurate information and promptly update it when necessary. Notify us promptly if you believe an account has been accessed without authorization.
14. Privacy and Electronic Communications
Our Privacy Policy explains how we collect, use, and protect personal information. By submitting an order, account registration, contact form, or other electronic communication, you consent to receive communications necessary to process and administer your request or transaction.
Marketing email is optional. If you subscribe, you may unsubscribe using the link included in our marketing emails. Transactional, service, safety, recall, and account communications may still be sent when appropriate.
15. Third-Party Services and Links
The Site may link to or use services operated by third parties, including payment processors, shipping carriers, FFLs, dealers, distributors, social-media platforms, and other websites. EBP does not control and is not responsible for third-party content, availability, security, or practices. Your dealings with a third party are governed by that party’s terms and policies.
16. Site Availability and Disclaimer
We work to keep the Site accurate, secure, and available, but do not guarantee uninterrupted or error-free operation. The Site may be unavailable for maintenance, technical failures, security reasons, or circumstances outside our reasonable control.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND GENERAL SITE CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. THIS SITE DISCLAIMER DOES NOT LIMIT ANY EXPRESS WRITTEN PRODUCT WARRANTY PROVIDED BY EBP OR ANY RIGHT THAT CANNOT LAWFULLY BE DISCLAIMED.
17. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EBP WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATED TO USE OF OR INABILITY TO USE THE SITE, EVEN IF ADVISED THAT SUCH DAMAGES MAY BE POSSIBLE.
THIS SECTION DOES NOT LIMIT LIABILITY THAT CANNOT LAWFULLY BE LIMITED AND DOES NOT REPLACE OR ALTER THE REMEDIES, EXCLUSIONS, DISCLAIMERS, OR LIABILITY LIMITATIONS IN AN APPLICABLE WRITTEN PRODUCT WARRANTY. PRODUCT-RELATED CLAIMS REMAIN SUBJECT TO THE CONTROLLING WARRANTY, PRODUCT INSTRUCTIONS, AND LAW.
18. Governing Law and Venue
These Terms and any dispute arising from the Site or an order are governed by the laws of the State of Missouri, without regard to conflict-of-law rules, except to the extent federal law applies.
To the fullest extent permitted by law, any legal action arising from these Terms, the Site, or an order must be brought in a state or federal court having jurisdiction in or serving Ralls County, Missouri. You and EBP consent to the personal jurisdiction and venue of those courts. This section does not prevent either party from pursuing a remedy in small-claims court when legally available.
The separate Limited Lifetime Warranty provides that the warranty is executed and intended to be performed in Perry, Missouri; that Missouri substantive law governs its validity, construction, and enforcement; and that actions to enforce it are subject to the venue and jurisdiction provision stated in the warranty. The warranty’s provision controls for an action to enforce that warranty.
19. Changes to These Terms
We may update these Terms from time to time. The revised Terms will be posted on the Site with a new effective date. Changes apply prospectively unless applicable law requires otherwise. The Terms in effect when an order is accepted ordinarily govern that order, together with any transaction-specific written terms.
20. Severability; No Waiver; Entire Agreement
If a provision of these Terms is held unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver of the right to enforce it later.
These Terms, the Privacy Policy, applicable published sales and return policies, the applicable written product warranty, and any transaction-specific written agreement form the agreement between you and EBP concerning the Site and your order. Transaction-specific written terms control over these Terms to the extent of a direct conflict relating to that transaction.
